Oh My God! My Car!
oh god! some punk ran through an intersection without stopping! knocked the crap out of me! my whole fender is busted! the door, window, headlight, the whole right side. it launched my headlight down the street. the wheel is completely mangled and bent in towards the engine. god if i had been going just a little faster it may have really hurt my girlfriend. jesus...

yeah. thanks. that was the first thing i was worried about. then i got the bastard to move his truck and my car just fell off it...my poor rim. i ALMOST used my tax return for black bullitts. do you think the axle may have bent? i mean the rim was really pushed in at a sharp angle. i'm afraid the insurance company will total it. i'm still upside down so i will be screwed if they only give me the blue book value of the car. can anybody give me some tips on how to handle them?

Hmm, does your neck hurt?? GF's neck hurting? Mine would be. Yes officer I would like to go to the hospital because I am in pain. My neck and back hurts really bad.. Plus it might not be too late even if you said I'm ok . When I got home my back started hurting really bad, I think I need a dollar collar.. I'd get a personal injury lawyer. You might have whiplash.. GF too. that's 2 times the settlement for personal injury, if he has insurance??..

ok... first thing first: DO NOT USE A LAWYER unless you are personally sued. You have insurance and they have lawyers coming out their azz.
Go see a doctor... complain of neck and back pain. Go BACK to the doctor in a week and tell them the pain is still there. Your GF should do the same. This builds a history of pain and suffering. Go back every once in a while and get checked out. Save receipts.
You have ZERO fault in the accident if you didn't do anything wrong so the other guy's insurance will call you with an "offer" of settlement. Don't take it if it pays for your car and that's it.
I'd ask for 10K pain, suffering and future medical for you and your GF (each, provided that the accident was severe looking), plus 15% over the replacement value of your car and every single mod you've done plus labor. It's not your car their replacing... it's your "loss". Your loss was a well modded car and the lack of pain and suffering for 2 people for the forseeable future. Your insurance company should have exactly 0 payout on this one and they really shouldn't get involved much. Tell your adjuster to call the other insurance company and handle your **** for you.
Trust me... a close friend is an insurance adjuster. This is how I've been told to handle it. They just get pissed off when you bring some azzhat lawyer into it and if you do use a lawyer I promise you only he will make a goddamned dime.

Honestly its deff not worth the hassel to try to sue. I tryed it a while back when I got rear ended and I ended up dropping all charges.
First thing I did is call an attorney, he then recommended me to HIS doctor. It was all rigged up, the doctor and the attorney were good friends so ofcourse the doctor wrote all this **** on it so the doctor could get a cut out of it too.
Then I had to go to the doctor as much as I could, the more I went the more money I walked out with, but in florida the max you can get is $10,000 if its a really crazy accident. My accident wasn't too big. Honestly to me it just wasn't worth having to leave work early 1 or 2 times a week to go to court later and just end up walking out with $4,000-$5,000.

I agree to the lawyer part. Obviously you weren't hurt, but you could have been. His insurance should pay you for suffering of any sort. I know if someone wrecked my car I would be hurting. (probably for real), but when you take so much time to care for your vehicle, then someone smashes into you, To me that's grounds for personal injury.. And I would accept the same if I slammed someone and it's my fault. That's why we pay insurance premiums, That for most people are never used.. Settle for a few grand above what your car is worth. because it's probably worth more to you than any bluebook value..
