I agree, I only buy brand new things. I did buy a camera that was used, but it was only 2 weeks used and I've never had a problem with it.

Not to **** in your cornflakes, but 90% of the time, PayPal awards in the favor of the buyer. Putting "As-Is" in your description would NOT have helped in this situation. My wife, Mother-In-Law and I have over 10 years of experience with eBay. Both of them have over 4,800 feedback each and I have 678. Now, with that said, here is what sux about PayPal. All that the buyer has to do is sneeze and PayPal will lock your **** up quicker than Jack getting caught with one of them male prostitutes. They will then hold the funds in your account until a resolution is finalized. NOW, if the funds are not in your PayPal account, they will first attempt to suck them from your bank account. If your bank account doesn't have them, they will go after the Credit Card on file. If they STILL can't get the funds, a collection agency will.
Now, for the bright side, if the negative he left says NOTHING about the red light problem and only the shipping mix up, make sure PayPal sees this. That will help let them know that this is buyers remorse and NOT a defective item. They will ALWAYS award in the favor of the seller if you can prove or if they decide it was buyers remorse.
Based on the emails I have read, I think you have a slight edge in this case. Only issue is who on PayPal's side is appointed to this and if they have the same thoughts as me.

In todays world, it is not always about "buyer bewhere"....that is such an over-used term. The seller ALSO has to beware.
I have sold quite a few mustang parts over the last few years. I always include shipping and I usually give the buyer 5 days to return for complete refund....no questions asked, but he must pay return freight.
I do this for one reason...I don't want people bad-mouthing me on the boards for something that I sold them. If they are not happy, they can send it back.
In your case, this is a much more expensiive item then I normally sell, however. And I agree that this could be a buyer's remorse situation. But, IMO, their motives really don't matter as it is difficult to prove. What matters are the legal facts and I hope for your sake that Ebay will resolve soon.

Well good news, and odd news.
After alllllllllll of this has happened, I get this E-mail from his mother:
"mr. hart,
I want you to be aware that after dicussing this problem with you , my son when he called to have the xbox shipped to be repaired discovered the warranty as you stated in your description on ebay; was not current and he was quoted a price of 140.00 to have the xbox repaired. suprisely when he called the second time he was told there was now a warranty on the xbox and all he had to pay was shipping and handling. As of today he received a replacement xbox that appears to be in good condition and he and I are both satified with the outcome. that's all I wanted, a fair compromise and or resolution to this problem.thank-you."
Well, whatever, I'm glad it's done but wish they would of not been so flippin difficult.
Now paypal is currently reviewing the case and there is no way for me to tell them that we have come to a compromise. I think I just need to wait.

That's because the orignal warranty from Microsoft was for 90 days. But, as December 22, 2006 they've extended that to a full year, and is retroactive to previously bought systems. See the link for complete story.

If it were me, I would reimburse the buyer for the shipping they paid to have MS fix the box. They will give you good feedback and PayPal may close the case quicker. And besides, it's a fair and honest thing to do.
Ok.. Flame me.. but that's just the way I do business and would expect to be treated as a buyer.
