opinion needed..am i screwed?

Default opinion needed..am i screwed?

tonight on my way home from my girls house, i got pulled over and issued a ticket for "spinning my tires, racing other vehicle, and reckless driving". heres my side of the story:
I was driving the speed limit on a 2 lane road, the other vehicle that i was supposively racing was riding my rear bumper to the point I couldn't see his headlights and i saw nothing but his grill in my rear bumper. still remaining the speed limit i contiuned to drive down the 2 lane road he backed off a little, as we approached the traffic light to where we were both apparently turning right he got back on my *** so i took the turn at a quicker pace(not so fast to the point of spinning my tires, but not a granny turn either) to attempt to put space between us and apparently he turned too quickly and spun his tires. I then accelerated to the speed limit as he floored it to just above the speed limit saw the cop and stopped accelerating at around the speed limit and turned off, the cop followed him and pulled him over. at this point i was like wow ocoee pd really did it right and pulled over the *** hole and not the innocent, right as i finished this thought a cop sitting at the next light flashed his light into my car. i stopped at the light with him staring at me, light turns green i go and he then follows. clicks on his lights i pull over. he and 2 other cops come up to my car and i was asked to give my license and regist blah blah, as i was handing it over i said "sir, may i ask why i am being pulled over?" his reply was "ARE YOU KIDDING ME?!" and he walked away the other cop asked if i had anything in the car he should know about and asked if he could search the car i replied "no sir i have nothing in the car, please feel more then free to search my car" he said ok thanks and walked away. officer came back and with a ticket in hand and said i'm citing you for reckless driving, i interjected with "sir how was i driving reckless i dont understand" he replyed with that stupid 4runner you were racing as you came around the corner you spun the tires and so did he, and dont think he got of scotch free either i pulled him over. I interjected here as well saying "no, i saw you pull him over, but i didn't spin my tires. I do my racing at the track sir (i have numbers from earlier tonight on my car). I understand i have a bad record, but i've been trying to drive better and do any and all racing at the track, I swear i wasn't racing or spinning my tires'' he replies "look i saw you fly around that corner then i heard SKRRRT then the 4runner and SKRRT, take it up with the judge" they walked away.

so here i am no clue what to do.

Well i guess it depends if you can sweet talk a judge, IMO if you really were doing as you say, cop was ****** wrong as usual. If you want, talk to the judge and try to get the cops dashcam, and see if it catches you "Spinning" youre tires. Btw how much was the fine for?

i have to go to court, the officer said that penalty could lead up to jail time. :/ no fine just court to face the judge.

Just got out of a similar situation. GET A LAWYER!!! Cops won't deal with you but they will with a lawyer.

Not to be mean, and it's only due to that it's early on Saturday, but I'm not going to read it until you capitalize and use paragraphs. (Washes hands of it) Take it for what it's worth lol.

I am going to start off by saying that this is not my advice, it would be very bad advice and is by any definition of the law totally illegal

Fabricating evidence is a crime

but if someone were to do it in this case they might do the following I however do not condone any of these actions

1. One might obtain a bag of sand/gravel
2. One might go to the place where the cop says they spun the tires
3. One might place the contents of bag on road discretely during a low traffic time (at night)
4. One might drive over it many time to make it look like it has always been there for some time
5. One might then photograph said scene (during the next day)
6. One might then present these photos to thier lawyer to serve as a defence for wheel spin without racing.

As I said before this is illegal and I don't condone these actions

I read it. I would get a lawyer or at least talk to a lawyer. With the charges they gave you, it could **** you up for a long time. If you were really guilty, I would fight and and just take whatever they gave you. But since you calim innocence, you need a lawyer so you don't get stuck with some fines, car impound, whatever the consequences are.

i dunno where you guys live, but i get no trouble from cops like that. i have yet to even get pulled over since i started driving. :O

Thats Orlando cops for you, I got pulled over doing 50mph in a 45mph and got issued a $180.oo ticket!

sounds like what a cop around here would do. anyways I say when you see the judge, in some way of implying that you don't street race, you could say why would I waste my time with my coupe on an SUV...it doesn't make sense.

In the cops defense, you WERE driving recklessly by flying through that turn. But I would've done the same thing.

I've been pretty lucky when someone wants to try me, But if it's a SUV, I'll let them go by and not even try it. Some Ricers too. Sometimes, escpecially on weekends, it doesn't pay to mess around with anyone who wants to race ya.. Just let em go, But if I dont see headlights in front or behind me and someone is playing around. I might let my stang eat a little bit, From a dead stop, most times it's short and sweet. Just a good leave in 1st gear then the big slam to 2nd and if I feel cocky a big slam to 3rd. and that's usually it. Either your eating them up by then or they're eating you up, sometimes too close to call, but I'll let off either way.. Who really cares in the long run.. Next time someone is on your *** that close, tap the brakes kinda hard.. They usually get the message..

I usually give it a little left foot tap, if it's at night. If it's during the day, I let them get good and close and flip on my headlights, it's not the same but they don't have time to reason it out.

I didn't "fly" though the turn i just made it a tad faster then i normally would. it was like maybe 30-35ish. (speed limit was 40 then after the turn 45)

he was too close he would have hit me had i even touched the brakes to slow down...which is why i took the turn faster to create space.

like i said had i tapped the brakes i wouldn't have a rear bumper anymore

i have a speeding ticket from over a year ago that was 30 over (on a highway at 2am) and a ticket a few months after that for 15 over and like 2 tickets for 5-10 over nothing of street racing or reckless driving

No offense, I'm sure you're a good guy and all, but... Most police officers that I have met have a serious god complex. Every police officer around here apparently seem to feel that they are above the law, they never use blinkers, they always drive 10-15+ miles per hour over the speed limit and probably 50% of the time they are blabbing on their cell phones. On the local bypass here in Gallatin it isn't out of the ordinary to see a cop driving about 90Mph for no apparent reason, no lights on, nothing. I have very little respect for most of them, they're basically just making the city extra money.

Back on topic... You're probably going to need a lawyer. Unfortunately if you try to fight it yourself, the judge is going to see your record and if the P.O. is in court you'll be fucked.

Sorry about your luck man, next time you should just give him a good brake check, he hits you, it's his fault. You must maintain control of your vehicle at all times and give yourself plenty of room to react to anything that happens in front of you. If someone is doing that to me, I'll typically just try to get over if there is any way to do it. I think it's funny to catch back up with them when they get stopped at the next red light then look over & laugh at them because their big hurry obviously didn't get them anywhere.. The proper way to give a brake check is coming up to a red light or a stop sign, just get on the brakes a little harder than normal, they hit you and your explanation is just "I was slowing down for the red light occifer."

LOL, I've done that too. Another thing that will catch anyone of guard is to downshift to 2nd and let the tranny slow ya down in a hurry, You can see their face, ( oh ****) they have to hit their brakes to keep from hitting you.

If you get hit from behind, then you have a case. And if I'm gonna go to that extreme, which I normally would not, ( I would hate to get even a scratch on my stang), But if I do get hit I'm gonna be hurt really bad. Like I said in another thread, Dollar Collar, ambulance ride, my back, and neck hurts really bad. my fingers are going numb. Please get me to the hospital, I can't feel my legs, and I think I'm gonna pass out..

Really?.. Next time you take a turn maybe you should glance at your speedometer.. I'd be willing to bet that it's not out of the ordinary to be doing 20-25Mph, so 30 isn't really anyhing overly excessive.

with how my luck is though the guy that would be the one to actually hit me in the rear will not have insurance and be a broke **** so i couldn't even sue him.

I would say the real reason he pulled you over cause you were in a tiburon and he just wanted to laugh. haha.

Just messin man, I would say fight it. Best bet would probably be to get a lawyer since you got wreckless driving and everything. It can't hurt. Good luck.

Were you speeding?

Then you're guilty. Stop bitching because it was ONLY 5 mph over. If you're over the speed limit, you're speeding, case closed.

yeah ok, but 5mph over isnt reckless driving as he is being charged with.
