Default Got Creamed.

I was coming out of a small sidestreet making a left turn late at night. Me & 'lil mama were in the Stang. I'm almost to the median; making my turn when out of nowhere this woman smashes the **** out of my Mustang. She had absolutely no lights on whatsoever. ******* almost killed us both, she hit us at least 45 mph. The car went spinning and smashed into the curb. We're both okay now, it happened on the 27th at about 9:00 at night. The car is at the shop... It's supposed to be fixxed around the 20th of January. Frame is fine. Certain parts of the engine bay need to be rewelded, tires and rims destroyed, fender destroyed, strut, tire rod and front bumper destroyed; and so are the headlight and turn signal. I'm glad we're okay though, it could have been worse.

this is all i have, it was much worse after it got torn down though.

****! I have been wondering where you were and if you'd just stopped posting or something. I'm glad you and 'lil mama are okay, man. At least the car can be fixed.

it always amazes me by the people that don't have their headlights on when driving at night... I mean do they seriously not realize there off... haha. Good to hear everyone is ok

+1 I've actually seen people drive with just their parking lights at night.

I also hate when people don't have their headlights on in the rain or in the fog. ******' morons. It's not always so you can see, it's so others can see you.

Havokk, do you know if she received a ticket?

She was actually sited, yes. There's a police report as well. But despite all my arguing yelling, and making myself sick over it, they (MY insurance) are telling me that I am partially liable for the accident. I don't understand how the I'm supposed to yield to something that i can't ******* see?? I can't seem to win this one.

and wat insurance do you have cuz thats just stupid that they say that ur partially liable for the accident. I dont think its ur fault since the fact that the other person driving didnt have there light on at night. Ya you need to fight this one

damn... **** awhile back my wife was involed in a hit and run and our inurance covered the whole car, which was about 7g's, the reason for that was cuz the car was totaled and i know that our insurance didnt say "We are partially liable for the accident cuz we didnt see the car coming" i mean god damn man that type of insurance is just wanting an excuse not to really pay the damages on ur car

But if they still say "Ur partially liable for the accident" i would get a lawyer and fight it and then once you win switch insurance company's

oh and we have state farm

Tell them it is horseshit, they can either pay up on what they claim you are partially liable for, or you willl hire the best laywer you can find and take them to court and cost them far more in court fees and time and energy fighting a case they know damn good and well they wont win.

they are just trying to get out of paying up. This is common, somtimes you need to threaten lawsuit and they will just fold over because they know a lawsuit will cost them more in the end

judging by those pics, i cant see how she was going 45 mph.. my accident looked much worse than that..

Those pictures are ****. You should see the engine bay, the back of the fender and the door. The tire was even under the car after she hit us. She was going fast man, the car got rocked so hard we spun and ended up hitting the curb on the other side of the road. Like i said... it was over $7000 worth of damage.

Other than that if you don't believe me i don't know what to say. Lastly, don't start with me ******. I am not in the ****** mood.

When I totaled my GTO, I was going under 30mph. I wish I had pictures of it to post on here. You'd probably **** your pants. I have no idea how I walked away without even a scratch.

That happend to a friend a few years back and it took almost 1,400 bucks out of his own pocket to fight it. The lawyer didn't make him pay until it was settled but all the running around - gas, mileage wise and time off of work and fees he had to pay up front for documents was a pain. In the end all he got was - by the time the lawyer took his part was the cost of the damage paid for BARELY, court cost. And when it was over his insurance drop him because they said he was a risk.

It was a major pain since the guy didn't have insurance either. If the truck wasn't in such good shape and he hadn't put so much money in it he said he wouldn't have gone through it.

Man, that sucks. Sucks real bad...but again, cars are replaceable. Glad you and yours are OK.

With that said, I am sorry you have Progressive- and I am not being sarcastic. I see this every day, and it really pisses me off to see people get railroaded. I work in a collision / restoration shop, and just last month had an 05 Toyota truck with high mileage (130K). The adjuster from Progressive would not accept the fact that the truck was totaled. It was hit in the left front fender / grille, at an angle, and the impact knocked the RIGHT frame rail back far enough that there was a bigger gap on the right side of the cab, and standing over the rear bumper, the right side stuck out over an inch. We ended up setting up the gauges to prove it to him. It was bad. He went out to his truck for a good 45 minutes, and said he had found a "used" chassis. I have to wonder that if it's in the junkyard, why is it there? The same reason this one oughta be.

Sorry for rambling, but Progressive is the worst, and Nationwide is right there with them. I could go on and on. I don't mean to ruffle anyone's feathers- in case you happen to be employed by them, insured by them, or whatever. I am simply stating what I see on a daily basis, and those are the two words we hate to hear the most.

On a positive note, again, glad everyone's alright! Good luck with it all.

I haven't got an official answer as to the liabillity percentage but apparently whatever part liable she is, comes out of my deductible. I wasn't aware of this. I'm supposed to get the car back late next week and I can't wait.

I think this raises a question in general about insurance and what it is actually meant for. It looks like you were jolted pretty good, it seems it was not your fault, and it seems that liability should rest on the one at fault..

It just makes me wonder if maybe you should have sustained some injuries, at least some kinda neck and/or back injuries to both of you. You may feel fine now, but what if in the next few days you start to notice pain. If that ever happens to me, then my first reply to the first responder when they ask me "Are you OK". I am going to say Nope. I am hurt, and I cannot move my neck without pain.. Dammit, then lets go to court.. Sorry but insurance should step in and do what we all pay for but rarely use.. If the other driver has just liability, then I'm going for all I can get..

so did the insurance company take care of everything? Still getting the car back ontime? I had my hood latch break(somehow) and my hood went through the windshield and caved in the roof. Over 5k in damage, but my insurance didnt give me any ****. I have usaa though.
