Default what are my rights?

i mentioned i had my first (ahem) official accident last week...i'm just wondering what my rights are dealing with the other guys ins company....he wrote and signed a letter taking full responsibility for the accident and offered to pay but refused when he saw the appraisal...so i filed an accident report and now his insurance comp is calling so my questions:




i know i have to let the other insurance company examine my car but i get to pick where right?


i get to pick where its fixed?


i dont have to sign anything except a check right?


do they have to give me a rental whiel they fix it?

Yes the have to provide a rental for you, while your car is getting repaird and you do have the right to choose where to have it fixed. I would just go with the one they recommend. They usually have high quality collision centers owned by them and they get the job done. The only thing they will make you sign is an estimate report which states everything that will get fixed.

thats up to your insurance company if you get the rental...its an extra on your coverage if you get a replacement rental car until yours is fixed. Its a toss up whether or not you get to pick where you want it fixed. Usually its an "approved" shop by the insurance company...right?

Nope, that coverage is there in case the person that hits you doesn't have insurance. The other parties insurance pays for the rental car.

thats right, the person who hit you's insurance pays for your rental car. If you were going through your insurance, then it's a matter of whether or not you have that option. Just take it to wherever you want. You don't get a choice on the rental car though. The insurance usually only pays a certain amount per day and that usually equals the compact cars.

It all depends on your insurance company and what your policy includes. Some places mandate that you use certain shops etc....

You need to learn the term "subrugate". Your insurance company may end up making a deal with them on the side that you can get stuck with. BTW, the other driver was a dumbass for admiting in writing.

Technically the other driver is NOT at fault unless there is a police report and some states won't write one unless there is an injury or a citation was issued. It could be termed as just a no-fault accident which means your insurance company calls the shots and you are stuck with what they say.

Here is what will happen:

Your insuurance will cover it like it was a no fault. Then, they will try to subrugate or deal with the other company. If they get money from the other company, then that is used to pay your company and may end up also helping you too.

Most insurance companies will pay an authorised shop directly, or send you a check in the mail. The other company has a right to inspect the car and determine what they think the damage is worth.

actually what happened is that the other company wants to settle this thing before the lawsuit...they tell me that i can take my car to vinny from the neighborhood to have the work done...thank god cause i know vin will have it looking like new...heh heh...so next week i drop it off and looks like this really worked out...i hear that jamaican asswipe that hit my car got fired for writing the statement and hell i feel like its christmas already


is it possible that i get a corvette convertible rental? or maybe a hertz mustang gt?

you would have to pay the difference between the compact car rate and the premium car rate for the rental if you want anything but a radio on wheels.

The hertz shelby's are a world class mother füker to rent. Bring a utility bill, your drivers license, insurance card, and 2 credit cards that have funds available for a "hold".

too much work...hmm besides my stang is still in perfect condition...wouldnt mind a chrysler 300 then...always wondered how those bodega mobiles handled on a day to day but wouldnt spend a penny on it since it became the official ghetto car of 2007...but on their coin maybe

not to mention that shelby hertz only has like 20 more horsepower than your GT, but is probably heavier.

i really do want to rent a mustang gt one day though...just to see what my stang is really capable of... i wanna drift, donut, smoke tires until the block fogs up..all that stuff that would be too expensive for me to really enjoy in my private car

that would be awesome but is also the reason you need all that **** waterDR was talking about to rent one.

Funny....that depends on where you live. Drive around where I live and all you see if familes and business men in them. Go downtown Minneapolis, and that all changes.
