Default My Car Got Stolen

Yes, my car was stolen on 7/17. It was my wife's Saab 93. Taken right from our driveway. Thieves made-off my her passport, laptop, etc....

Yesterday morning, the Police recovered the car and made an arrest. Last night, we got most of our posessions back. The investigation involved 3 jurisdictions. One kid in is jail (he is 17) and 4 kids are being charged as well.

The police have entered two properties so far and found numerous items stolen from as many as 5 cars. There are still more crooks at large, but more arrests are imminent. This kid will likely see some extended jail time.

My car was towed to my house (I had to pay for the tow) and the car is nasty. The car was mint when they took it, but looks like they went mudding with it....it is filthy inside and out.

I am waiting for the insurance to deal with some of this and am asking them to inspect car inside and out and all mechanicals. I am also asking the DA for full restitution from the thief to pay for all of my costs not covered by insurance.

I will keep you posted.

Damn.. That sucks. Do you live in a place that doesn't have a garage, or do you just have too many cars to fit them all in there?

I wish the latter was my problem :/ I need a garage

sucks about that whole ordeal, are all of these kids underage? the DA will most likely side with you and make the parents/whoever is responsible for these stupid kids pay, honestly if it was me I would take it a step further and sue them for grievances too

I live in an Mayberry-type town. I have a house with a garage, but own a boat and three cars. At the time the car was taken, two of my cars were in the shop and this one was on the driveway.

grievances FTW. once something gets messsed up and it gets repaired, its never as good as it was. Plus u had the inconvenience and stress of the vehicle being gone, so give them hell and set an example out of them so all their friends can see, and maybe that will settle alot down.

I smell civil suit. Being a gaggle of minors, their parents may be liable for civil damages depending on the laws in your state. Don't forget to add gross pay time off work for every day the car was gone regardless of actually being off work or not, rental car, and "night terrors" and "anxiety". Note any damage to the driveway, even skid marks or a broken potted plant. They're losses you should recoup.

Good luck with the whole situation though man. Glad you at least got it back. Asshats kiddies like him get *** raped in prison anyway. Be sure to ask the DA to prosecute the 17yo as an adult (which they'll probably do anyway) so he gets fucked by the biggest MF in the local hooscow.

That sucks big time. Hopefully, the minor was on his parents insurance policy, if he lives at home he should be. They should pay fully. Sucks for the parents, but that's life. As for any restitution that insurance doesn't pay, GL. Plus the hassle of getting a lawyer, and suing, and going to court, all adds up to time wasted cause some young **** decided to be a bad *** and steal something. I hate thieves, no matter what age they are. Hope he and the others end up where they belong. Like I said in a post earlier this month, in some other countries that would be a hand and a foot.. sounds harsh but I'd bet it would deter any crime in the US..

their parents ARE liable if they are not adults, must suck to be the parents. But yeah, grievances for sure man and like redneck said: "prosecute...as an adult" get them for all they got and make sure that punk a$$ gets jail time.

If it was me, and I was lucky to catch them breaking the window or something I would I shoot them in the face then tell the cops he tried to carjack you while you were in it. I don't know about whatever states you guys live in but down here in good o' Texas we have the RIGHT to shoot to death anyone threatening our life, liberty or property.

It used to be ONLY if they were inside your house but a new law passed with the last year or two amending it to include not only your house, but your property, your car and your place of business.

The only stipulation is that other than inside your house or on your property you MUST have a concealed hand gun license or be shooting with a rifle (which is pretty d*mn hard point blank with anything other than a sawed off shotgun)

Oh yeah, and NeedACobra.. have you ever spent any time with a cocaine dealer? I would rather spend the day with some random punk *** kid and beat him than spend a minute with a cocaine dealer.. maybe the cocaine dealers over in florida aren't as bad as the ones here.. I like to stay away from druggies strapped with automatic weapons

More than likely I have, however, drugs annoy the **** out of me, its like some kind of ******* trendy thing to do now days, and I think drug dealers are pathetic. I Know alot actually through people I know, or I probably went to school with them.

But I was using that as a comparison, because I absolutely ******* hate thieves more than anything.

Thanks for the thoughts guys. I am with you all....thieves suck.

I have actually taken some law classes and I think TV dramas wrongly show real life.

The fact is, the system will sort this out. I am not in control of the what he DA does or what the DA does not do. This is a criminal matter. The DA makes the charges and the judge will rule on the outcome. There are a lot of factors that are considered such as age of the suspect, prior record (he is clean), total damages, and cooperation.

Under the law, I am entitled to be made "whole" by the courts. If my car is determined to be fine, or can be restored, then I can ask the court for restitution from the suspect. The court will also consider the fact that I am insured etc...

If in my opinion criminal court does not make fair restitution, then I can take the suspect to civil court. However, this is an expensive and time consuming process and th elikelihood of getting money from a kid is very low. While he is a minor, he could prove emancipation which leaves me with nothing.

Going after things like mental anguish etc... are really hard to prove and difficult to place a value on it. Getting damages like this from a 17 year old indivdual is nearly impossible. These are called punnitive damages and are usually done to "teach a lesson" for entities with BIG pockets as a way to deter the sam behavior.

Best case...get my car fixed, get my **** back, and ask suspect to pay for un-returned items. Bascially, get him to pay for any out of pocket expenses including my deductables. The insurance company may decide to go after him too, but I doubt that they will.

Florida might be headed in that direction. We recently got the stand your ground law.

OP sounds like you know your ****. I hope the situation is made right for you. Keep us posted on how things go.

I'm really sorry to hear about this dude, I hope it all works out. I had a neighbor that had their car stolen once and I know how tough it can be on you, your family and your mentality. Like I said, I hope it all works out and for what it's worth I'll be praying for you in this trying time.
