Default Help: Sounds too good.

I've been chatting with this guy at this Premier Auto Company to get people out of their payments. Be serious about it if you reply, what do you think... scam or am i lucky?? I'll post up the contract as well.

The process is very simple:

#1 We at Premier Auto Select meet with you the owner of the vehicle and sign the contract
that we have with you gauranteeing us to make the payments on your car
for the duration of the loan.

#2 We then find qualified buyers with insurance to take over the current existing
loan that you have already with your finance company. We then do a credit check
and verify that they are going to be reliable and responsible for those payments.

#3 We then install a GPS system in the car that we can track and shut down if need
be at anytime.

#4 We then upon verification of insurance, valid drivers license, employment verification,
and a reference check, would recieve a down payment from the permissive user to
drive the car.

#5 At this point when a permissive user is located and placed in the vehicle, we would
contact you and give you all the permissive user's information D.L. number, proof of insurance,
and any work and home address that is related, and direct phone numbers.

#6 At this point you would stay in contact with the permissive user throughout the duration
of the loan. If for any reason you lose contact and are unable to locate the permissive user,
or if you ever recieve any phone calls from the finance company, that speaks of a missed
payment or late payment, you will notify us immediately and we will then contact the finance
company ourselves and place the missed payment on a company credit card at that point.

#7 We then at that point in time would try to locate, the permissive user ourselves and if we
are unable to locate them, we would then at that time shut the car down using the GPS
system installed, and go reposess the vehicle.

#8 We then will make any payments that come due during the time we have it back in our
possesion, and proceed to locate another qualified user to assume the loan, and would proceed
with legal action to acquire any dues owed to us by the previous permissive user.

#9 After 6 months of good payment history from the permissive user, we would then contact the
finance company and have the title transferred into the permissive user's name, and the loan
would state (Paid in Full) on your credit at that time, and your name is completely off the loan.

#10 If for some reason after 6 months the permissive user that is in the car at that time, has not
been in the vehicle for the full 6 months, meaning if we had to transfer it from one user to
another, at the end of the 6 month period, to honor what we say in the contract to you, we
would register the vehicle in the company's name.

PREMIER AUTO

Payment Guarantee Agreement



This agreement made this __________ day of ______________, 20_______, by and between PREMIER AUTO, and________________________(“you or the Owner”} in Reference to the following vehicle. ­­­


YEAR_______ MAKE___________ MODEL__________VIN#_______________________


PAYMENT GUARANTEE: When PREMIER AUTO fully executes this contract (that is, when the owner and PREMIER AUTO sign the contract, then at that point PREMIER AUTO will guarantee the payments every month for 6 months on this vehicle for as long as it is under contract with PREMIER AUTO or unless the balance is paid in full on the remainder of the loan or lease as detailed in the Closed End Use Agreement, unless terminated for any reason by the owner. This guarantee extends to payments that are due and payable during the terms as detail in the closed end use agreement. This guarantee includes, but is not limited to, the following circumstances: 1) any payments that the User fails to pay in timely fashion as prescribed in the Closed End Use Agreement, and 2) any payments that may become due should PREMIER AUTO deem it necessary to repossess said vehicle from User, and until such time that another User is located. If PREMIER AUTO receives any documented complaints from you, the Owner, due to default by the User or PREMIER AUTO will discuss with you the possibility of terminating the Closed End Use Agreement. In the event you elect to terminate the Closed End Use Agreement, you have the option to take possession of your vehicle, at which point PREMIER AUTO obligation to guarantee payment will cease, or to ask PREMIER AUTO to procure another qualified User. Upon agreement to terminate, you will inform PREMIER AUTO in writing immediately of the termination and your decision as to whether you choose to take possession of the vehicle or your desire for procurement of another User or PREMIER AUTO is responsible for the Payment Guarantee Agreement and this agreement will terminate upon the satisfactory conclusion of the Closed End Use Agreement, any substitute or replacement therefore, or upon agreement to terminate the Payment Guarantee Agreement. In the event your agreement to provide possession and use of vehicle causes the owner of or security interest holder in your vehicle to institute legal proceedings against you alleging that this Agreement with PREMIER AUTO constitutes a breach of contract or default under any agreement relating to the vehicle with such parties, provided you have provided complete copies of such agreements to PREMIER AUTO, PREMIER AUTO agrees to indemnify you for damages or liabilities or judgments rendered against you by such parties relating to such breach or default.

INSURANCE COVERAGE: If during the term of the Use Agreement insurance coverage on your vehicle should lapse or be cancelled or said vehicle is returned by the User, or repossessed by PREMIER AUTO on your behalf, PREMIER AUTO will reinsure the vehicle at our expense, to ensure that the vehicle is properly covered, in the amounts that are required by your lien holder.
At no time at all during the process will you ever be held responsible for the permissive user’s actions in your vehicle. You will at all times be listed as a secondary as the permissive user is listed as the primary
driver. You will be listed on their insurance policy as strictly an additional interest. Or a secondary.

This constitutes the entire payment guarantee agreement, between you and PREMIER AUTO and PREMIER AUTO assumes no liability for statements made by associates that are outside of these contract stipulations. The laws of Arizona shall govern the construction and interpretation of this contract and all parties agree to submit to the personal jurisdiction of the Arizona courts should legal action arise. In the event of suit, the prevailing party shall be entitled to reimbursement of reasonable attorney fees.



You agree to deliver possession and use of your vehicle as described above in the event that PREMIER AUTO locates an acceptable Permissive User. You agree that PREMIER AUTO has not made any
1. representations or assurances regarding any prospective User’s qualifications or creditworthiness as an inducement for you to enter into this Agreement. You agree that PREMIER AUTO does not represent or warrant that a qualified User will be located and obtained or that you will receive any payment, compensation or consideration of any kind from PREMIER AUTO or any prospective User, other than as detailed in C.E.U.A. use payment computation. PREMIER AUTO agrees that you may terminate this Agreement at any time prior to a User being located. You understand that, other than the right to use the vehicle during the term of the Closed End Use Agreement, the User has no interest in the vehicle and that you are not assigning any of your interest in the vehicle to the User. After the permissive user has established 6 months of good payment history with PREMIER AUTO, we would then at that time have the title transferred into the permissive user’s name, with the written permission of you the owner. If for any reason the permissive user does not maintain their end of the 6 month payment trial, the remaining months will either be paid by another permissive user, or PREMIER AUTO until the trial period ends
If for any reason the permissive user is unable to acquire financing at the end of 6 months,
than at that time and only at that time after the permissive user has failed to acquire financing,
PREMIER AUTO will assume the entire remaining balance of the loan.


2. You agree to allow PREMIER AUTO to show your vehicle to prospective Users and to cooperate with PREMIER AUTO regarding appointments for showing the vehicle. PREMIER AUTO will provide space for parking the vehicle until such time as a User is located, to help accommodate the showing of the vehicle, however, you will maintain full control over said vehicle during this time. You agree to make payments and continue insurance in the vehicle for no more than 10-14 days from date of this contract, if for some reason the permissive user should backout in that 10-14 days, PREMIER AUTO will place insurance on the vehicle until a permissive user replaces the insurance for PREMIER AUTO.

3. When PREMIER AUTO locates an acceptable User and an Agreement is entered into, you agree to notify PREMIER AUTO of any default of payment to lienholder, within 7 days of payment. In the event that PREMIER AUTO. has not received payment by the User’s due date, which is 10 days prior to your actual payment due date, the User is in default and PREMIER AUTO must notify owner immediately and agrees to make payment to your lien holder prior to any late payment being reported to any credit bureau. PREMIER AUTO also guarantees payment of any late fees and penalties. If you elect to take possession of your vehicle while the vehicle is in default, you must do so prior to PREMIER AUTO’S payment to cure the default. Once default has been cured, it may no longer be used as a basis to take possession of your vehicle. If PREMIER AUTO makes a late payment to your financial institution at any time owner reserves the right to require vehicle be returned by PREMIER AUTO to owner immediately and to terminate this agreement. If for any reason owner decides to
ask for the vehicle back at anytime, and a permissive user has already been located and paid fee's to
assume the payments on the vehicle, the owner will be held responsible for any compensation due to
the permissive user and or PREMIER AUTO. This includes down payments, monthly payments,
GPS installation costs, and any insurance payments made by the permissive user or
PREMIER AUTO and will be recieved prior to vehicle being returned for security purposes.

Sounds somewhat legit but i would still be nervous. Maybe try to find someone who has used them.

I had several of those places contact me when i was selling my stang.

My reson for not going with them,

A) The loan is still in MY name
B) i am no longer in posession of the vehicle

What if the "Permissive buyer" starts smoking in the car, burns the seat, doesent wash it properly, and just takes real lousy care of the car.

Oh yeah, and anyone who knows how to install a stereo can yank out the GPS.

I diddnt realize you were selling. honestly i wouldnt do any type of sale unless the car leaves your posession along with the loan. to easy to get burned.

the problem with selling modded cars is everyone is paranoid that you beat the tar out of the engine. Evenrually somone will see your car and want THAT car. Thats how it was when mine got sold, the guy went through craigslist ads, saw mine and was determined to buy it.

that right there rings a red ******* bell. NO GPS ever goes in my damn car. EVER.
