He's right about that. If you HAVE no-fault insurance, then both parties insurances pay for their damage. If you were injured, that's when you are able to sue, putting the other driver at fault. If you live out of state and don't pay Michigan insurance, then I have no idea. I'd tell you to talk to your insurance agent, but then obviously they'll know. I guess if you have a clean record, it might be easier to report it.
