The class action lawsuit on behalf of a New York man and other buyers of the 2007 Roush Stage 3 BlackJack vehicles claimed they paid a premium price of nearly $59,000 (30,000 pounds) last year because Ford advertised that only 100 would be made.

The lawsuit, filed in U.S. District Court in Manhattan, accused Ford and Roush Performance Products Inc of manufacturing at least 100 more of the vehicles in 2008.

Representatives of Ford were not immediately available to comment, a company spokeswoman said.

"The vehicles purchased by the plaintiff and the other class members were not as unique or rare as the defendants had stated them to be," the complaint said. "Their value from scarcity and as collectors' items were and are dramatically less than the buyers had been led to believe their value would be."

Ford manufactured a limited run of a modified version of the Ford Mustang, made especially for conversion by Roush into the Stage 3 BlackJack, the complaint said.

Drew Conner of Bardonia, N.Y., and at least 100 other people are members of the class seeking a jury trial and more than $12 million in damages.

Question, why are they suing ford, and not Roush? Doesn't roush determine how many mustangs they convert to Roush mustangs, and have no direct relation with Ford?

Also, as a co-worker just pointed out, the limited edition claim was for 100 in 2007. That's all that were built. 2008 is a whole NEW model year. And as the article states, Roush is only makeing another 100 for 2008. So the claim was; There were only going to be 100 built in 2007. The reality is; They only made 100 in 2007. No breach of claim in my eyes.

Its getting to the point where the rarest mustangs are the ones that are not a part of a special edition or limited edition package

the rarest mustangs are the one's in our garages for most are modded to our standards, not others. so in reality, you and i have more unique cars than the the Blackjack. lol

as for the lawsuit, i believe that the plaintiff is in the wrong. and i agree with RCtrucker7 for the facts.

There is a guy in town here that has a Blackjack with only 26 miles on it. He trailers it to shows and never drives it. Asshole IMO. The Blackjack is at the top of the list of Roush cars that should be put on a track/raced/driven hard.

But yeah as long as only 100 were made in '07, 100 in '08 I don't see the problem.
