Default "Pre-catalytic" filter?

I was looking around at different shop websites because we are going to get the mustang (2007 GT) tuned and i came across this at alternative auto's website. Thay claim 4-5 horsepower form removing it. Can you just remove it without getting a tune, or messing up the factory computer? It seems like it could be a big restriction in airflow.

That is one of the reasons why 05+ Mustangs need a tune w/ a CAI since they remove that.
